Use the site lawfully, do not copy it wholesale or scrape it, and treat what is on it as general information rather than advice or a fixed quote.
Your rights under the Australian Consumer Law are not affected by anything here. If we do work for you, that engagement runs on the proposal and terms we sign with you, not on this page. Queensland law governs.
About these terms
This website is operated by Enhance Industries Pty Ltd (ABN 78 165 968 392), trading as Enhance Industries, from the Gold Coast, Queensland. These terms govern your use of the website.
Accepting these terms
By using this website you accept these terms. If you do not accept them, please do not use the site. We may change these terms at any time by updating this page; the version published here when you use the site is the version that applies, and the date it last changed is shown at the top.
What these terms do not cover
These terms are about the website, not about work we do for clients. If we quote you for a project, that engagement is governed by the proposal, quote and terms of engagement we give you at the time, which are signed separately.
Where those documents and this page disagree about a client engagement, the engagement documents win.
Using this website
You may read this site, and print or save pages of it for your own reference or to evaluate us as a supplier. You must not:
- copy, republish or resell any part of the site or its content for commercial purposes without our written permission;
- use it unlawfully, or in a way that damages it, overloads it, or interferes with anyone else’s use of it;
- attempt to gain unauthorised access to the site, its server, or any connected system;
- scrape, harvest or extract content or contact details by automated means without our written permission;
- introduce any virus, malware or other harmful code;
- use our name, branding or content in a way that suggests we endorse you when we do not.
Information on this website
We take reasonable care with what we publish, but the site is general information about our services. It is not advice, and it is not a substitute for advice about your particular circumstances.
Prices, timeframes, statistics, search-volume figures and case study results are indicative and current at the time of publication. Results we have achieved for one client are not a promise of the same results for you – too much depends on your market, your budget and your competition. Nothing on this site is an offer capable of acceptance; a quote we give you in writing is.
Intellectual property
Unless we say otherwise, everything on this site – the text, design, code, graphics, logos and layout – is owned by us or licensed to us, and is protected by copyright and other intellectual property laws.
The client work shown in our portfolio remains the property of those clients, and their names and logos are their trade marks. We show that work to demonstrate ours.
Material you send us
When you send us an enquiry, a brief, or files for a project, you keep ownership of it. You give us permission to use it for the purpose you sent it – to answer you, to prepare a quote, or to do the work.
You confirm that you have the right to give us whatever you send, including any photographs, logos, text or customer data, and that our using it for the project will not infringe anyone else’s rights. Please do not send us confidential information you do not want us to have, and do not send us more personal information about other people than the job needs.
Links to other websites
This site links to other websites, including those of our clients. We do not control them and we are not responsible for their content, their accuracy, or what they do with your information. A link is not an endorsement.
Availability of the site
We try to keep the site available and current, but we do not guarantee it will be uninterrupted, error-free, or free of viruses. We may change, suspend or withdraw any part of it at any time without notice.
Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees, or any other right you have that cannot lawfully be excluded.
If you are a consumer within the meaning of the Australian Consumer Law, you are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage.
Our liability
Subject to the section above, and to the extent the law permits:
- we exclude all conditions, warranties and guarantees that would otherwise be implied into these terms;
- we are not liable for any indirect or consequential loss, or for loss of profit, revenue, data, goodwill or anticipated savings, arising out of your use of this website;
- where our liability can be limited rather than excluded, our total liability arising out of your use of this website is limited, at our option, to resupplying the relevant services or paying the cost of having them resupplied.
You use this website at your own risk.
Indemnity
You indemnify us against any claim, loss or cost we suffer arising from your breach of these terms, your unlawful use of the site, or from material you send us that infringes someone else’s rights.
Privacy
Our Privacy Policy explains what personal information we collect through this site and how we handle it. It forms part of these terms.
Governing law
These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them.
General
If any part of these terms is found to be unenforceable, that part is severed and the rest continues to apply. If we do not enforce a right immediately, we do not give it up. These terms, together with our Privacy Policy, are the entire agreement between us about your use of this website.
